摘 要
文章综合分析中国相关法律法规对农民土地权益的相关规定，尤其是对新颁布的《物权法》进行了重点研究，从而总结出农民的土地权益的构造包括农民土地承包经营权、农民宅基地使用权和自留山、自留地使用权、农民因在集体组织中的成员身份所享有的土地收益等权利，列举了农民土地权益的基本形态。从完善农民的土地权益的构造及其形态出发，分析农民土地权益的基本现状，得出农民土地权益在某些方面存在1定的形态缺失问题，提出了要明确界定公共利益、完善征地补偿标准、建立失地农民保障、规范政府行为等措施，同时建议重视农民在土地征收中意义自治的特殊补偿方式。

ABSTRACT
The thesis gives a comprehensive analysis of Chinas relevant laws and regulations on land rights and interests of peasants, and focus on the newly issued "real law," and concludes that the land rights and interests of peasants has the right to operate land contracted to peasants , the right to use the curtilage , private hill and plot, the right to enjoy the profit of the land as a member in the collective organization and interests basic shape. From consummates farmers land rights and interests structure and the shape, analyzes the farmer land rights and interests the basic present situation, obtains the farmer land rights and interests to have certain right flaw in certain aspects, proposed must be clear about the limits public interest, the consummation drafts compensates the standard, the establishment loses the farmer to safeguard, measures and so on standard government behavior, simultaneously suggested takes the farmer in the land collection the significance autonomous special compensation way.
